Purpose of this policy<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">This policy describes the way in which PoliceScan supports professionals subject to the obligation to keep a register of movable objects, commonly called a \u201cSecond-hand goods register\u201d.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan is a digital management support tool. It allows you to record, organize, store and export information relating to acquisitions of second-hand goods and collectibles.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Keeping a register of movable objects is mandatory for professionals involved in the purchase, sale, exchange or consignment of certain used movable objects. A prior declaration of the activity must also be made to the competent authority.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">2. Regulatory framework<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The register of movable objects is governed in particular by:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">article 321-7 of the Penal Code;<\/li>\n\n\n\n<li class=\"\">articles R. 321-1 to R. 321-8 of the Penal Code;<\/li>\n\n\n\n<li class=\"\">the texts relating to computerized record keeping;<\/li>\n\n\n\n<li class=\"\">the regulations applicable to the protection of personal data.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The regulations authorize the keeping of the register by means of automated processing of personal data. In this case, maintaining a listed and initialed physical register is not necessary, provided that the system complies with the requirements applicable to the digital register.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">3. Role of PoliceScan<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan has been designed to facilitate:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">the identification of sellers;<\/li>\n\n\n\n<li class=\"\">the chronological recording of acquisitions;<\/li>\n\n\n\n<li class=\"\">the attribution of a reference to purchases and objects;<\/li>\n\n\n\n<li class=\"\">the description of the acquired objects;<\/li>\n\n\n\n<li class=\"\">the recording of their provenance;<\/li>\n\n\n\n<li class=\"\">recording the purchase price;<\/li>\n\n\n\n<li class=\"\">recording the payment method;<\/li>\n\n\n\n<li class=\"\">the retention of supporting documents;<\/li>\n\n\n\n<li class=\"\">generation of purchase receipts;<\/li>\n\n\n\n<li class=\"\">consultation of the history;<\/li>\n\n\n\n<li class=\"\">generating a registry export;<\/li>\n\n\n\n<li class=\"\">the traceability of validated operations.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan does not constitute an administration, a control authority or a certification body. Its use does not constitute individual validation of the register by a public authority.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">4. Seller Information<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">For an acquisition made from a natural person, the register must in particular make it possible to identify the person who sold, exchanged or deposited the objects.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan provides for the recording of information such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">the name;<\/li>\n\n\n\n<li class=\"\">the first name;<\/li>\n\n\n\n<li class=\"\">the address;<\/li>\n\n\n\n<li class=\"\">the quality of the person;<\/li>\n\n\n\n<li class=\"\">the nature of the identity document presented;<\/li>\n\n\n\n<li class=\"\">its number;<\/li>\n\n\n\n<li class=\"\">its date of issue;<\/li>\n\n\n\n<li class=\"\">the authority which issued it.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">When an operation is carried out on behalf of a legal entity, information relating to the company and its representative must be recorded in accordance with the applicable rules. These mentions are provided for by article R. 321-3 of the Penal Code.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user remains responsible for verifying the identity of the seller and the accuracy of the information entered.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">5. Item information<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan allows you to record information relating to goods acquired or held for sale or exchange.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">This information may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">the nature of the object;<\/li>\n\n\n\n<li class=\"\">its provenance;<\/li>\n\n\n\n<li class=\"\">its description;<\/li>\n\n\n\n<li class=\"\">its category;<\/li>\n\n\n\n<li class=\"\">its brand or license;<\/li>\n\n\n\n<li class=\"\">its series;<\/li>\n\n\n\n<li class=\"\">its number or reference;<\/li>\n\n\n\n<li class=\"\">its state;<\/li>\n\n\n\n<li class=\"\">its particular characteristics;<\/li>\n\n\n\n<li class=\"\">photographs;<\/li>\n\n\n\n<li class=\"\">the quantity;<\/li>\n\n\n\n<li class=\"\">the date of the operation.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The regulations provide that the register must mention the nature, origin and description of the objects acquired or held with a view to sale or exchange.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user must provide a sufficiently precise description to allow the identification of the objects concerned.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">6. Order number and connection of objects<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Each object displayed for sale or held in stock must be linked to a serial number.<\/p>\n\n\n\n<p class=\"has-text-align-left alignwide wp-block-paragraph\">The regulations provide that this number be entered in the register and appear on the object or lot concerned. Certain low-value objects can, when the regulatory conditions are met, be grouped under a common description and number.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan allows you to associate objects with a purchase reference and to keep this connection in the register and inventory.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">It is up to the user to correctly report or associate this reference on the object, batch, label, storage box or any other support used in their professional organization.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">7. Purchase price and method of payment<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan provides for recording:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">of the purchase price of each item or lot;<\/li>\n\n\n\n<li class=\"\">of the payment method;<\/li>\n\n\n\n<li class=\"\">multiple payments when used;<\/li>\n\n\n\n<li class=\"\">of the estimated value in the event of donation, exchange or deposit when this information is necessary.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The register must include the purchase price and method of payment for each item or lot. In the event of an exchange, free acquisition or deposit, an estimate of the market value may be required.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user remains responsible for the accuracy of the amounts and payment methods recorded.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">8. Chronological order and validation<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Acquisitions recorded in PoliceScan are associated with a creation date and, when validated, with a validation date and time.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The operation of PoliceScan distinguishes in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">draft operations;<\/li>\n\n\n\n<li class=\"\">validated operations;<\/li>\n\n\n\n<li class=\"\">the objects attached to an acquisition;<\/li>\n\n\n\n<li class=\"\">the generated documents;<\/li>\n\n\n\n<li class=\"\">any sales subsequently recorded.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">A draft remains editable until it is validated.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user must verify all information before final validation of the purchase.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Validation constitutes an important step in the traceability of the operation. However, it does not exempt the user from verifying that the recorded data corresponds to the actual transaction.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">9. Integrity, intangibility and security<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The regulations applicable to the computerized register require that automated processing guarantees the integrity, intangibility and security of the recorded data.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan implements mechanisms intended to contribute to these objectives, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">user authentication;<\/li>\n\n\n\n<li class=\"\">access control;<\/li>\n\n\n\n<li class=\"\">recording of dates and times;<\/li>\n\n\n\n<li class=\"\">association of operations with the company account;<\/li>\n\n\n\n<li class=\"\">conservation of purchase references;<\/li>\n\n\n\n<li class=\"\">saves data in a cloud infrastructure;<\/li>\n\n\n\n<li class=\"\">generation of documents and exports;<\/li>\n\n\n\n<li class=\"\">security rules limiting access to data;<\/li>\n\n\n\n<li class=\"\">conservation of links between purchases, objects, inventory and sales.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Registry security also depends on user practices. This must in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">protect your identifiers;<\/li>\n\n\n\n<li class=\"\">not share your account in an unauthorized manner;<\/li>\n\n\n\n<li class=\"\">regularly check its data;<\/li>\n\n\n\n<li class=\"\">perform the necessary exports;<\/li>\n\n\n\n<li class=\"\">keep your supporting documents;<\/li>\n\n\n\n<li class=\"\">use a secure device;<\/li>\n\n\n\n<li class=\"\">report any suspicious access.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">10. Modifications and corrections<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user must verify the information before validation.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">When a correction is necessary, it must be carried out in such a way as not to fraudulently mask the initial transaction or create inaccurate information.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Knowingly entering inaccurate information in the register is punishable by the Penal Code.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan should not be used for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">falsify an identity;<\/li>\n\n\n\n<li class=\"\">artificially modify the origin of an object;<\/li>\n\n\n\n<li class=\"\">delete an acquisition in order to conceal its existence;<\/li>\n\n\n\n<li class=\"\">backdate an operation;<\/li>\n\n\n\n<li class=\"\">create a false receipt;<\/li>\n\n\n\n<li class=\"\">intentionally register an inaccurate price or payment method.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user is responsible for any information he enters, corrects or validates.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">11. Conservation of supporting documents<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan allows you to associate or generate certain documents, in particular:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">purchase receipts;<\/li>\n\n\n\n<li class=\"\">vouchers;<\/li>\n\n\n\n<li class=\"\">invoices from professional sellers;<\/li>\n\n\n\n<li class=\"\">identity documents or identification references;<\/li>\n\n\n\n<li class=\"\">photographs;<\/li>\n\n\n\n<li class=\"\">payment receipts;<\/li>\n\n\n\n<li class=\"\">exports PDF or Excel.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The use of PoliceScan does not exempt the professional from keeping the documents necessary for his activity for the applicable legal periods.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The presence of a document in PoliceScan does not alone guarantee its validity, authenticity or legal sufficiency.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">12. Export and presentation in case of inspection<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan allows you to generate a registry export from the recorded data.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">This export can be used for:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">consult operations;<\/li>\n\n\n\n<li class=\"\">present acquisitions by period;<\/li>\n\n\n\n<li class=\"\">find information relating to a seller;<\/li>\n\n\n\n<li class=\"\">find the origin of an object;<\/li>\n\n\n\n<li class=\"\">check the purchase price and payment method;<\/li>\n\n\n\n<li class=\"\">transmit the information requested during an inspection.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The professional must be able to present his register to the competent services when the regulations require it.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The export can only be complete if the user has correctly recorded and validated all the operations concerned.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">13. Prior declaration of the activity<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The use of PoliceScan does not automatically carry out the prior declaration required for the activity of reseller of movable objects.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The professional concerned must make this declaration themselves to the prefecture, sub-prefecture or police headquarters in Paris, depending on their place of practice.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan does not automatically check that this formality has been completed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">14. User responsibility<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user remains solely responsible:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">to determine whether he is subject to the obligation to keep a register;<\/li>\n\n\n\n<li class=\"\">to make the necessary administrative declarations;<\/li>\n\n\n\n<li class=\"\">to verify the identity of the sellers;<\/li>\n\n\n\n<li class=\"\">to enter all the mandatory information;<\/li>\n\n\n\n<li class=\"\">to correctly describe objects;<\/li>\n\n\n\n<li class=\"\">to assign and use appropriate references;<\/li>\n\n\n\n<li class=\"\">to keep supporting documents;<\/li>\n\n\n\n<li class=\"\">to validate the operations in the appropriate order;<\/li>\n\n\n\n<li class=\"\">to verify the data proposed by artificial intelligence;<\/li>\n\n\n\n<li class=\"\">to produce the register in the event of an inspection;<\/li>\n\n\n\n<li class=\"\">to respect the retention periods;<\/li>\n\n\n\n<li class=\"\">to respect the GDPR and the rights of data subjects;<\/li>\n\n\n\n<li class=\"\">to have their procedures validated by a competent professional when their situation requires it.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">15. Limitations of PoliceScan<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan is a support tool.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan does not guarantee registry compliance when:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">mandatory information was not entered;<\/li>\n\n\n\n<li class=\"\">the information entered is false or incomplete;<\/li>\n\n\n\n<li class=\"\">user validates incorrect identification;<\/li>\n\n\n\n<li class=\"\">purchases are not recorded;<\/li>\n\n\n\n<li class=\"\">objects are attached to the wrong batch;<\/li>\n\n\n\n<li class=\"\">references are not reported on objects or batches;<\/li>\n\n\n\n<li class=\"\">supporting documents are not retained;<\/li>\n\n\n\n<li class=\"\">the user does not respect his other professional obligations;<\/li>\n\n\n\n<li class=\"\">the configuration or use of the software is diverted from its purpose.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Compliance depends on the functionality of the software, their configuration, the accuracy of the data entered and the professional&rsquo;s practices.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">16. Regulatory and technical developments<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The regulations and requirements applicable to purchase-resale professionals may evolve.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">Valoryn may update PoliceScan and this policy to reflect:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li class=\"\">legislative or regulatory developments;<\/li>\n\n\n\n<li class=\"\">user requests;<\/li>\n\n\n\n<li class=\"\">technical developments;<\/li>\n\n\n\n<li class=\"\">recommendations from the authorities;<\/li>\n\n\n\n<li class=\"\">the addition of new categories of objects;<\/li>\n\n\n\n<li class=\"\">of the evolution of exports and traceability mechanisms.<\/li>\n<\/ul>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">The user must use an up-to-date version of PoliceScan and regularly check the rules applicable to their activity.<\/p>\n\n\n\n<h2 class=\"wp-block-heading alignwide\">17. Absence of administrative certification<\/h2>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">PoliceScan is not presented as software officially certified or approved by an administration, unless specific certification or approval has been obtained and subsequently published.<\/p>\n\n\n\n<p class=\"alignwide wp-block-paragraph\">This policy describes the design objectives and intended operation of the service.
